Article 1 (Application of Terms of Use)

The “SHISEIDO GLOBAL FLAGSHIP STORE Website” (hereinafter, “the Website”) is the website operated by Shiseido Company, Limited and Shiseido Japan Co., Ltd. (hereinafter collectively referred to as “Shiseido.”)

These “SHISEIDO GLOBAL FLAGSHIP STORE Website Terms of Use” (hereinafter, “these Terms”) set forth the basic matters pertaining to the use of various services provided through the Website (hereinafter, “Services.”)
These Terms shall be applied to all Service users (including users who have registered their personal information based on the provisions of Article 2, paragraph 2; hereinafter collectively referred to as “Users.”)

Article 2 (Definition of Users)

  1. 1.Users, in these Terms, mean all persons to use Service regardless of whether they can be identified by Shiseido.
  2. 2.Users who have separately agreed to the “SHISEIDO GLOBAL FLAGSHIP STORE Terms of Use” and have registered their personal information in accordance with the prescribed procedures may use Services, etc. that require to be pre-booked (hereinafter, “Pre-Booked Services”) which are provided in the SHISEIDO GLOBAL FLAGSHIP STORE (Address: Hankyu Hanshin Ginza Building 1F, 2F and B1, 3-3-13 Ginza, Chuo-ku, Tokyo; hereinafter, “SHISEIDO GLOBAL FLAGSHIP STORE”) operated by Shiseido.

Article 3 (Acceptance of Terms of Use)

A User who has actually used Services shall be regarded as having agreed to these Terms.

Article 4 (Equipment, etc. Required to Use Services)

Any terminals, communications equipment, software, and other equipment and communications charges, etc. required to receive Services shall be borne by the User.

Article 5 (Notification of Changes to Terms)

Shiseido reserves the right to revise the content of these Terms in whole or in part without prior notice to Users. In this case, Shiseido will notify Users of the revision on the Website, and the revised terms will become effective when they are posted on the Website.

Article 6 (Prohibited Acts)

Shiseido prohibits Users from engaging in any of the following acts (including engaging in acts which induce such acts or preparing to engage in such acts) in their use of the Website:

  1. (1)Slandering, defaming, or causing damage to the reputation of other Users, third parties, or Shiseido (including its affiliates), or acts that may cause such damage;
  2. (2)Damaging the property rights or privacy of other Users, third parties, or Shiseido (including its affiliates), or acts that may cause such damage;
  3. (3)Infringing upon the intellectual property rights (copyright, design rights, patent rights, utility model rights, trademark rights, portrait rights, etc.) of other Users, third parties, or Shiseido (including its affiliates), or acts that may infringe upon such rights;
  4. (4)Sending or posting harmful computer programs, etc.;
  5. (5)Acts contrary to public order and morals, criminal acts, or acts that may constitute the same;
  6. (6)Using Services for profit or making preparations to do so;
  7. (7)Election campaign activities and the like, or other political and religious activities;
  8. (8)Acts that otherwise hinder the operation of Services;
  9. (9)Using personal information registered by another User in order to use Pre-Booked Services (including but not limited to the User’s name, phone number, e-mail address, and password set by the User for the use of Pre-Booked Services; hereinafter, collectively referred to as “Another User’s Personal Information, etc.”) to use Services;
  10. (10)Acquiring, disclosing, or providing Another User’s Personal Information, etc. in any manner; and
  11. (11)Acts in violation of the laws of Japan or the country/region where the User is located when they use the Website.

Article 7 (Responsibility for Use of Information Provided on the Website)

Shiseido makes no guarantee as to the completeness or utility, etc. of the information obtained by Users through the Website such as information transmitted by other Users. Users shall use the Website at their own risk, and Shiseido assumes no liability with respect to the outcomes of a User’s use or reliance upon the aforementioned information, etc.

Article 8 (Copyright and Other Intellectual Property Rights)

  1. 1.All rights associated with content published on the Website are owned by or used by Shiseido under license or other valid title, and Shiseido prohibits Users from using any of the content published on the Website for any purpose other than the User’s own personal use, publicly re-posting such content within or outside the network, or using or reproducing such content without authorization, etc.
  2. 2.All trademarks and service marks appearing on the Website are owned by Shiseido or its affiliates or used under license or other valid title, and Shiseido prohibits Users from using them without authorization.
  3. 3.Users shall transfer any copyright (including the rights prescribed in Article 27 and Article 28 of the Copyright Act) or other intellectual property rights associated with the information, etc. that they have provided to Shiseido free of charge and shall not exercise their moral rights of the author, etc.

Article 9 (Change / Addition / Discontinuation of Services)

  1. 1.Shiseido may temporarily suspend or discontinue provision of Services in whole or in part without prior notice to Users in the following cases:
    1. (1)To perform regular and emergency work to inspect and maintain the system for provision of Services, etc.;
    2. (2)When the system for provision of Services has failed, etc.;
    3. (3)When the provision of Services has been rendered difficult by power outage, fire, earthquake, or other force majeure;
    4. (4)When there are any other valid operational or technical grounds to suspend or discontinue provision of Services.
  2. 2.Shiseido reserves the right to change the content of Services in whole or in part, add new Services, or discontinue Services without prior notice to Users.
  3. 3.Shiseido assumes no liability for any disadvantage or damages suffered by Users in the case of each of the preceding paragraphs.

Article 10 (Third-Party Websites)

Shiseido assumes no liability and will not be obliged to pay compensation for damages resulting from the use of websites managed or operated by third parties accessed via links from the Website.

Article 11 (Handling of Personal Information)

  1. 1.In principle, Users do not need to provide personal information that may identify them such as their address and name, etc. when accessing and browsing the Website.
  2. 2.Users may need to provide their personal information to Shiseido to use the following services on the Website. Users shall bear any communications charges and provider fees, etc. necessary to access the Website, in addition to Pre-Booked Service usage fees,
    1. (1)when making a pre-booking for SHISEIDO GLOBAL FLAGSHIP STORE Pre-Booked Services through the Website; or
    2. (2)when applying to win prizes such as samples and gifts on the Website.
  3. 3.Shiseido will manage personal information provided by Users appropriately in accordance with the “SHISEIDO GLOBAL FLAGSHIP STORE Terms of Use” and “About Personal Information.

Article 12 (Disclaimer and Compensation for Damages)

  1. 1.If a User has caused damage to Shiseido as a consequence of their violation of these Terms or other wrongdoing, then Shiseido may seek compensation for those damages from the User. If a User has caused damage to a third party in their use of Services, then they shall resolve that situation on their own responsibility.
  2. 2.Except as otherwise provided in these Terms, Shiseido assumes no liability to Users and third parties with respect to the outcomes from the use of Services, malfunction/failure of the system for provision of Services, or third-party intrusion into the system, or commercial disputes, etc. for whatever reason.

Article 13 (Website Security)

The Website protects Users’ personal information by using highly secure technology and maintaining a high level of security:

  1. (1)Protection from unauthorized access by firewall;
  2. (2)Regular analysis of access logs and an intrusion detection system to prevent unauthorized access;
  3. (3)Data encryption.

Article 14 (Use of Cookies)

  1. 1.Parts of the Website use cookies for the following purposes. The cookies on the Website function to store information the User has viewed on the Website on the User’s computer. The information collected through cookies does not include any “personally identifiable information” such as e-mail addresses or names.
    1. (1)If the Website has applications that span multiple pages, to temporarily store the information necessary to view the Website more conveniently;
    2. (2)When a User is logged in to the authentication service, to refer to the saved User registration information and provide a service customized to the User;
    3. (3)To allow Shiseido or a company entrusted by Shiseido to conduct research and analysis work to analyze User behavior on the Website to facilitate the provision of better services through the Website;
    4. (4)To display the most appropriate advertising to the User on other companies’ websites based on the User’s interests and the usage situation on the Website;
    5. (5)To prompt Users who have not used the Website for a certain period of time to re-enter their password (re-authentication) for security purposes.
    Shiseido may allow contractors to whom it entrusts the delivery of advertising to save and refer to Website cookies through the contractors’ websites.
  2. 2.Users must agree to the provisions of the preceding paragraph and accept cookies to properly use the Services. Users may adjust their browser settings to block cookies but shall acknowledge that doing so may cause parts of the Website to not function properly or to become unusable.
  3. 3.Some pages of the Website use a technology called web beacons to collect statistics on the User’s usage situation of Services. Web beacons do not collect Users’ personal information, and Users may block the acquisition of information by web beacons by adjusting their browser settings to block cookies.

    Shiseido uses Google Analytics on the Website to understand the User’s usage situation of Services. Google Analytics uses the Website’s cookies to collect and analyze User information that does not include personal information.

Article 15 (Links to the Website)

  1. 1.Users are free to link to the Website. However, links may not be placed from a website that contains the following content:
    1. (1)Content contrary to public order and morals;
    2. (2)Content in violation of laws and regulations;
    3. (3)Content that defames Shiseido (including its affiliates) or related parties;
    4. (4)Other content that can be objectively judged to damage Shiseido’s corporate value.
  2. 2.If a User places a link to the Website, they shall link to the Website top page (URL: https://www.shiseido.co.jp/ginza/) in principle. Users acknowledge in advance that the linked page may be changed or taken down without notice.
  3. 3.Shiseido assumes no liability for any disadvantage or damages suffered as a consequence of Shiseido moving or erasing pages, etc. at its convenience.

Article 16 (Governing Law and Court of Competent Jurisdiction)

The Website and the interpretation and application of these Terms shall be governed by the laws of Japan. Unless otherwise specified, the Tokyo District Court shall have the exclusive jurisdiction as the court of first instance to hear all disputes arising in connection with the Website.
